As we have seen, data protection law does not always apply in the case of profiling practises. In the case of the collection of data that are not linkable to identifiable persons; in the case that data are used to construct a group profile and when the profile is applied to an anonymous user in a group, D95/46 may not be applicable. This can lead to a loss of control and creates questions as to autonomy and self-determination. We shall now investigate possible protection offered in the field of e-commerce and consumer protection law.
